Fully active. Buildings must complete both annual benchmarking and periodic tune-ups. Tune-ups require review and minor optimization of HVAC, lighting, and controls systems.

Penalties & Enforcement

Penalty

$2,000 initial + $500/day after 30 days

$2,000 initial fine for violations; $500/day for each day past 30 days after deadline for failing to file required reports

Compliance Requirements

Annual energy benchmarking via ENERGY STAR Portfolio Manager
Building energy tune-up every 5 years to optimize existing systems
Tune-up alternatives: certify high performance or receive exemption
Report tune-up findings and actions to the City

Data Required

12 months of utility consumption data (electricity, gas, oil, steam)
Building gross floor area
Building use type and occupancy
Tune-up report documenting system inspections and corrections
